MANUFACTURER'S WARRANTY TERMS AND CONDITIONS

INTRODUCTION

EXO kayaks manufactured by KPlast Srl are guaranteed against any manufacturing defects in the hull and its components for 3 years from the original date of purchase.

1st YEAR

During the first year of ownership, this warranty covers repair or replacement of the hull and components at 100% of the list price.

2nd YEAR

During the second year of ownership, this warranty covers repair or replacement of the hull and components at 100% of the list price.

3rd YEAR

During the third year of ownership, this warranty covers repair or replacement of the hull and components at 50% of the list price.

Models sold as "2nd choice" and/or demo kayaks are covered by a limited 1-year warranty from the original date of purchase for the hull and components at 60% of the list price for the first year, and at 40% of the list price for the second and final year.

This limited warranty is valid only with the purchase of an EXO Kayak from an authorized EXO dealer or directly from the manufacturer.

1) If you have a problem with your kayak and suspect it may be due to a defect in material or workmanship, contact your nearest authorized EXO dealer or EXO (Kplast Srl) directly.

2) If the inspection carried out by EXO or the authorized dealer indicates a defect attributable to material or workmanship, Kplast Srl may repair or replace the kayak under the company's warranty, based on the type of kayak and the date of purchase corresponding to the warranty coverage, as per the detailed schedule above. Proof of purchase, such as a sales receipt, invoice, or tax receipt, may be required. If a repair or warranty evaluation is requested from EXO (Kplast Srl), shipping costs remain the responsibility of the customer and are estimated at €100.00 including taxes.

3) If service is requested in a country other than the country of purchase, the consumer must comply with all export laws and regulations and will be responsible for all customs duties, value added tax (VAT), and other related taxes and charges. For international service, the EXO distributor may repair or replace products and parts with comparable defective products and components that comply with local regulations.

EXO (KPlast Srl) reserves the right to fulfill the warranty through the repair or replacement of products or components deemed defective. Furthermore, it reserves the right to replace original kayaks with the same product or with similar products.

THE WARRANTY DOES NOT APPLY IN THE FOLLOWING CASES
  1. Normal wear and tear and aging of the product.
  2. Kayaks damaged by extreme environmental weather conditions.
  3. Kayaks damaged by accident, negligence, misuse, or tampering.
  4. Kayaks that have been towed by motorboats or sailboats.
  5. Kayaks that have been used for activities other than those customary for the product.
  6. Kayaks that have been structurally or dimensionally altered or modified.
  7. Kayaks used for commercial or rental purposes; for these cases, different conditions will apply.

This warranty excludes direct or indirect damages or expenses arising from any defects. KPlast Srl's liability shall be limited to an amount equal to the original purchase price paid by the consumer for the defective product. Some states do not allow the exclusion or limitation of direct or indirect damages, so the above exclusion may not apply.

In no event shall KPlast Srl be liable for direct or indirect damages. The warranty grants specific rights and, in some cases, other rights that vary from state to state. The warranty is valid for the United States and Canada. International warranties for KPlast Srl are managed directly through our distributors and dealers.

To the extent that any limitation or exclusion contained in this document is contrary to the legislation of any country, such limitation or exclusion shall be severable and all other terms shall remain in full force and effect and are valid and effective.

This warranty grants specific rights and, in some cases, other rights. For consumers covered by consumer protection regulations, the benefits of this warranty are in addition to all rights provided by such consumer protection laws and regulations.
